1. Agreement to Terms

These Terms of Service ("Terms") govern your relationship with Fontana Water Damage Repair ("Company," "we," "us") regarding emergency water extraction, moisture mitigation, structural dehumidification, and related restoration services provided across Fontana and San Bernardino County, California. By engaging our emergency dispatch services or authorizing work on your premises, you agree to be bound by these Terms.

2. Scope of Emergency Services

Fontana Water Damage Repair provides rapid emergency water extraction, containment, moisture mapping, psychrometric drying, sanitization, and structural remediation in accordance with the Institute of Inspection Cleaning and Restoration Certification (IICRC) S500 benchmarks. While our dispatch target is physical arrival within 45 to 60 minutes across Fontana, response times may be impacted by severe weather conditions, highway closures, or major force majeure events.

3. Property Owner Responsibilities

To ensure effective and safe mitigation, the property owner or designated agent agrees to:

  • Grant our certified technicians safe, unobstructed access to the affected structures and utility shut-off controls.
  • Secure pets and remove fragile, irreplaceable, or personal high-value items from affected drying zones.
  • Maintain uninterrupted electrical power necessary to operate commercial low-grain refrigerant (LGR) dehumidifiers and air movers throughout the drying cycle.
  • Refrain from tampering with, powering off, or relocating commercial drying equipment without technician authorization.

4. Insurance Coordination & Billing Terms

We work cooperatively with property casualty insurance carriers using industry-standard Xactimate® pricing schedules:

  • Direct Billing: When requested, we submit psychrometric drying records, moisture readings, and itemized billing documentation directly to your carrier adjuster.
  • Policy Deductible: The property owner remains legally responsible for paying their insurance policy deductible as mandated by California insurance laws.
  • Non-Covered Losses: In the event an insurance carrier denies coverage for pre-existing long-term rot, deferred maintenance, or non-covered perils, the property owner remains responsible for actual mitigation services rendered.

5. Hazardous Materials & Pre-Existing Conditions

Structures built prior to 1980 may contain asbestos, lead-based paint, or legacy building materials. In accordance with California Department of Public Health (CDPH) guidelines, our crew will conduct rapid material screening prior to aggressive drywall cutting or demolition. We are not liable for pre-existing foundation cracks, architectural defects, or prior unmitigated mold colonies discovered during water extraction.

6. Equipment Safety & Care

Commercial drying machinery remains the exclusive property of Fontana Water Damage Repair. The customer agrees to exercise reasonable care to safeguard equipment installed on their property against theft, vandalism, or water submersion.

7. Limitation of Liability

To the fullest extent permitted under California law, the Company's cumulative liability for any loss, damage, or claim arising out of emergency mitigation services shall be limited to the total compensation received for the specific service call giving rise to the claim.

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California. Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the courts located in San Bernardino County, California.
